На первый взгляд в упомянутой норме Закона о банкротстве скрывается парадокс: Банк России или иной публичный субъект предоставляет кредитной организации финансирование на безвозмездной основе и несет из-за этого потери (неполученные процентные доходы), а правом на взыскание этих потерь наделяется кредитная организация, т.е. лицо, которое такие потери априори не испытывало. Это противоречит любым взглядам на убытки, которые существуют в теории гражданского права. Поэтому для того, чтобы сохранить за указанной нормой хоть какой-то юридический смысл, необходимо разобраться в том, какую именно экономическую модель регулирования подразумевали ее разработчики. Тем более что начинает складываться судебная практика при менения данной нормы и взыскания таких «парадоксальных» убытков с контролирующих лиц. То есть нельзя сказать, что норма получилась мертворожденной и блокируется правоприменителем. Оптимальный вариант — полагать, что Банк России имеет прямое требование к виновным лицам о компенсации своей упущенной выгоды, а кредитная организация, получившая от него финансирование, наделяется полномочиями по взысканию в его пользу либо обязанностью передать ему полученное. Второй важный момент рассматриваемой нормы — попытка переложить на контролирующих лиц расходы Банка России на внесение денежных средств в капитал банка. Это происходит в завуалированной форме — через проценты на взысканную сумму за 20 лет вперед, что при текущей ставке рефинансирования означает примерно 100% вложенной суммы. Однако надо учитывать, что, вкладывая такую сумму, Банк России забирает бизнес банка себе и далее, передавая этот бизнес иным лицам, он получает выручку. Собственники же банка не получают никакой адекватной компенсации, но должны возместить Банку России до 100% вложенных им средств. Это наблюдение вызывает фундаментальные сомнения в конституционности указанной нормы Закона о банкротстве.
