Залог из завещания

In his article the author analyzes the pledge established by the testator to secure the rights from testamentary bequest. Despite the absence of any mention of this type of security in the Russian Civil Code, the author comes to the conclusion that such will is permissible and legal under Russian law. The author also examines the legal effect of including the conditions for establishing a real security in the wills, the procedure for executing this will of the testator and other issues arising in connection with a testamentary pledge.

В статье анализируется залог, устанавливаемый завещателем для обеспечения прав из завещательного отказа. Несмотря на отсутствие упоминания об этом виде залога в действующем законодательстве России, автор приходит к выводу о том, что такое волеизъявление допустимо. В статье анализируются также юридический эффект включения в завещания условия об установлении залога, порядок исполнения этой воли завещателя и иные вопросы, возникающие в связи с завещательным залогом.
